Agreement to Terms

By accessing or using the services provided by BlueLeaf Town N Country Landscapers, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, users, and customers who access or use our landscaping services.

Services Provided

We provide professional landscaping services including but not limited to lawn care and maintenance, landscape design and installation, hardscaping, irrigation systems, tree services, sod installation, outdoor lighting, drainage solutions, seasonal cleanups, commercial landscaping, mulching, bed maintenance, and artificial turf installation. All services are provided according to industry standards and local regulations.

Service descriptions on our website are general in nature. Specific service details, scope, timeline, and pricing will be outlined in individual service agreements or proposals provided to clients before work begins.

Scheduling and Cancellations

We schedule services based on availability and weather conditions. For ongoing maintenance services, we establish regular schedules with clients. One-time services and projects are scheduled upon mutual agreement. We reserve the right to reschedule services due to inclement weather, equipment issues, or other circumstances beyond our control.

Clients may cancel or reschedule services by providing reasonable notice. Cancellations made less than 24 hours before a scheduled service may be subject to a cancellation fee. For larger projects requiring material orders or crew scheduling, cancellation policies will be outlined in the service agreement.

Payment Terms

Payment terms are outlined in individual service agreements. For routine maintenance services, payment is typically due after service is performed. For larger projects, we may require a deposit before work begins, with the balance due upon completion. We accept various payment methods including cash, check, and major credit cards.

Late payments may be subject to interest charges as permitted by law. If payment is not received within the specified timeframe, we reserve the right to suspend services until the account is current. Clients are responsible for any collection costs incurred due to non-payment.

Property Access and Responsibility

By engaging our services, you grant us permission to access your property to perform the agreed-upon work. You are responsible for ensuring that our crews have safe access to work areas and for identifying any hazards, underground utilities, or special conditions that may affect our work. We recommend calling 811 before any digging or excavation work to locate underground utilities.

While we take precautions to protect your property, you are responsible for securing pets, removing valuable or fragile items from work areas, and informing us of any irrigation systems, lighting, or other features that require special care. We are not responsible for damage to unmarked or improperly identified utilities, irrigation systems, or property features.

Warranty and Guarantee

We stand behind the quality of our work. For installation services such as sod, plants, hardscaping, or irrigation systems, we provide warranties as outlined in individual service agreements. These warranties typically cover defects in workmanship and, in some cases, plant material failures due to improper installation.

Warranties do not cover damage resulting from improper maintenance, extreme weather conditions, neglect, vandalism, or issues beyond our control. To maintain warranty coverage, clients must follow recommended care instructions and allow us to address any issues in a timely manner.

Limitation of Liability

To the fullest extent permitted by law, BlueLeaf Town N Country Landscapers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from our services. Our total liability for any claim related to our services shall not exceed the amount paid by the client for the specific service giving rise to the claim.

We maintain appropriate insurance coverage for our operations. In the event of property damage or injury caused by our negligence, our liability is limited to our insurance coverage limits.

Changes to Services and Terms

We reserve the right to modify our services, pricing, and these Terms of Service at any time. Changes to these terms will be posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the modified terms.

For existing service agreements, changes to terms will apply to renewals and new agreements, while existing agreements will remain subject to the terms in effect when they were executed unless both parties agree to modifications.

Dispute Resolution

If any dispute arises regarding our services, we encourage clients to contact us directly to resolve the matter. Most issues can be resolved through open communication and good-faith negotiation. If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing legal action.

These Terms of Service are governed by the laws of the State of Florida. Any legal proceedings related to these terms or our services shall be conducted in the appropriate courts of Hillsborough County, Florida.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
